Annual Reports of the Council and the General Board, and Reports and Financial Statements for 2014–15: Notice in response to Discussion remarks

29 February 2016

The Council, in consultation with the General Board, has considered the remarks made at the Discussion on 19 January 2016 (Reporter, 6412, 2015–16, p. 339) about the above Reports (Reporter, 6408, 2015–16, p. 226).

The Council notes the remarks of Professor Evans in relation to the appeal process and the standard of proof. It is indeed the case that an Officer who has been given an oral or written warning may choose between two avenues of appeal but this was previously the case under Statute U. It was not affected by Grace 2 of 10 June 2015 or the earlier Technical Review.

However, irrespective of whether an Officer chooses to appeal through the Grievance Procedure or apply to the Septemviri, the matters to be considered in both cases will be whether the decision has been made in accordance with the Statutes and Ordinances, and whether the Officer has been treated fairly. Although the processes would differ, Council does not expect there to be any difference in the substance of the decision to be made or any standard to be applied.

The Council is submitting a Grace for the approval of its Annual Report (which includes the General Board’s Report) (Grace 1, p. 412).
