Report of the Council on the regulations for the Local Examinations Syndicate: Notice

The Council have considered the remarks made at the Discussion of this Report on 28 October 1997 (p. 131).

 1. The Council have noted that Professor Lamb did not oppose the main proposals put forward in the Report, but that he commented on three points arising from the proposed regulations for the Local Examinations Syndicate.

(a) Professor Lamb asked the Council to clarify the intended timing of publication of the Syndicate's accounts. It is the Council's intention that these accounts should be published as part of the Syndicate's Annual Report, not as an appendix to the main University accounts; this will enable the accounts to appear earlier than at present. In order to make this possible, an amendment of Statute F will be required; the Council intend to bring forward proposals for an appropriate amendment in the near future.
(b) Professor Lamb asked the Council to adopt the practice of explicitly mentioning in their Annual Report the amount of any transfers made by the Syndicate to the Chest during the financial year (of the University). The Council confirm that it is their intention to do this.
(c) Professor Lamb commented adversely on the existing provision (Regulation 13(f) of the present regulations) under which the Syndicate have power to make donations to the Cambridge Commonwealth Trust, and on the proposed extension of this provision (draft Regulation 11(f)) which would allow the Syndicate to make donations to other similar trusts. The Council wish to review the operation of this regulation (and the question of the publication to the University of custodian trustee accounts, which Professor Lamb also raised) in consultation with the trusts concerned and with the Syndicate. They will publish a further Report or Notice about this matter when the consultation is completed.

 2. The Chairman of the Syndicate stressed the urgency of completing the proposed agreement with the Royal Society of Arts Examinations and Assessment Foundation, so as to meet the requirements of the Department for Education and Employment in connexion with the formation of the three new unified authorities for academic and vocational examinations, of which the University, through the proposed new company, would be one. Since there is only one point in the Council's proposals which has been called in question, viz. draft Regulation 11(f), and since this is a matter which the Council intend to review (see paragraph 1(c) above), the Council have agreed to modify the recommendations of their Report by reinstating for the time being the wording of the present regulation (i.e. Regulation 13(f) of the existing regulations; see Statutes and Ordinances, p. 137). They have accordingly amended draft Regulation 11(f) (see the Schedule to their Report, Reporter, p. 51) so as to read 'to make donations from time to time, subject to the approval of the Council, to the Cambridge Commonwealth Trust'. The Council are submitting a Grace to the Regent House (Grace 10, p. 150) for the approval of the recommendations of their Report, subject to this modification.
