Report of the Council on Statutes K, 5 (review) and K, 9 (delegation): Notice

The Council have considered the remarks made at the Discussion held on 10 October 2006 (Reporter, p. 79). The Council have noted the points made by the various speakers, but do not believe that the points made necessitate amendment of the proposals put forward.

Of the points mentioned on delegation, one is about the action the Vice-Chancellor would take if there was an allegation that he or she had committed a breach of the Statutes or Ordinances. While not excluding the possibility that the Vice-Chancellor would in person rule on such a matter (for example by making an immediate correction of an unintentional mistake) the Council would expect that the Vice-Chancellor would appoint a deputy to deal with such a matter. Comments were also made about time limits, but these are matters on which a balance of judgement is necessary. The Council believe that the proposals in the Report represent an appropriate balance between the need for reasonable time in which to raise a problem, and the need for a definitive decision to be reached reasonably promptly so that University business can proceed.

Accordingly the Council are promoting a Grace for the approval of the recommendations of the Report (Grace 4, p. 213).
