REPORT

Report of the University Council on the amendments of the Statutes and Ordinances in relation to the Finance Committee, buildings, and certain offices

The COUNCIL beg leave to report to the University as follows:

1. In their Reports, dated 8 March 2004 and 24 May 2004, the Council set out proposals for (a) the future responsibilities of the Finance Committee, the Planning and Resources Committee, and a new Buildings Committee (and sub-committees) (Reporter, 2003-04, p. 537) and (b) for the discharge of the formal functions of the offices of Secretary General and Treasurer as defined in the Statutes and Ordinances (Reporter, 2003-04, p. 714). These Reports have been discussed (Reporter, 2003-04, pp. 659 and 856) and the recommendations of the second Report have been approved by Grace 4 of 30 June 2004. Notices in reply have been published (Reporter, 2003-04, pp. 711 and 866).

2. As planned the Council now set out the proposals for amendments to the Statutes and Ordinances necessary to implement the proposals.

3. The Council therefore recommend:

I. That, subject to approval of Her Majesty in Council, the Statutes of the University be amended as set out below, and these amendments be submitted under the Common Seal of the University to Her Majesty in Council for approval.

II. That, subject to the approval of Recommendation I, regulations be amended as set out in the Annex to this Report, with effect from the following dates:

III. That, subject to the approval of recommendation I, Schedule B of the Statutes (University officers whose offices qualify them to hold Professorial Fellowships) be amended by removing the references to the Treasurer and the Secretary General of the Faculties, with effect from the date of approval of the amendments of Statute by Her Majesty in Council.

STATUTORY AMENDMENTS

Statute A

THE CHANCELLOR AND THE GOVERNMENT OF THE UNIVERSITY

Chapter II

POWERS OF THE UNIVERSITY

Section 7(c) (Custody of the Common Seal).

By replacing the words 'kept by the Registrary and the Treasurer' by the words 'kept by the Vice-Chancellor, or by a Pro-Vice-Chancellor designated from time to time by the Vice-Chancellor, such designation to be published, and by the Registrary'.

Chapter V

COMMITTEES OF THE COUNCIL

Section 1(a).

By amending the subsection so as to read:

(a)the following standing committees of the Council: the Finance Committee and the Audit Committee;

Sections 2, 3, 6, and 7 (The Executive Committee and the Consultative Committee).

By repealing these sections.

Section 5(a) (Duties of the Finance Committee).

By deleting the words ', and on the care and maintenance of all University sites and buildings'.

Section 8.

By adding a new section 8 so as to read:

8. Subject to the provisions of Statute A, IV, 2(e), the composition of the Audit Committee shall be determined by Ordinance. The Audit Committee shall perform such duties as may be assigned to it by Statute or Ordinance.

THE BOARD OF SCRUTINY

Section 4 (Prohibition on membership of the Board).

By deleting the references to the Secretary General of the Faculties and the Treasurer.

Statute C

SCHOOLS AND FACULTIES

Chapter I

THE GENERAL BOARD OF THE FACULTIES

Section 1(b) (Estimates).

By deleting the words 'the Finance Committee of'.

Section 11.

By adding a new section 11 so as to read:

11. The Registrary or a University officer designated from time to time by the Council after consultation with the General Board shall be Secretary of the Board.

THE UNIVERSITY OFFICERS

Chapter I

GENERAL PROVISIONS

Section 1(a) (Designation of certain University offices).

By deleting the references to the Secretary General of the Faculties and the Treasurer.

Chapter VIII

THE REGISTRARY, THE SECRETARY GENERAL OF THE FACULTIES

By amending the title of this chapter to read 'The Registrary' and by repealing sections 4, 5, and 6.

Section 8.

By deleting the words 'or of the Secretary General'.

Section 9.

By deleting the words 'or the office of Secretary General' and 'or an Acting Secretary General, as the case may be'.

Chapter IX

THE LIBRARIAN

Section 3.

By amending the final sentence so as to read 'The Secretary of the General Board, or a duly appointed deputy, shall be Secretary to the Board of Electors.'

Chapter X

THE TREASURER

By repealing this chapter.

Chapter XV

ELECTIONS TO PROFESSORSHIPS

Section 3.

By amending the third sentence so as to read 'The Registrary or a University officer designated by the Council (or a duly appointed deputy appointed by the Registrary or such University officer) shall act as Secretary to a Board of Electors.'

FINANCIAL MATTERS

Section 1.

By deleting the words 'acting on the advice of its Finance Committee,'.

By replacing references to 'the Finance Committee of the Council' or to 'the Finance Committee' by references to 'the Council or a duly authorized Committee of the Council'.

COMMENCEMENT, INTERPRETATION, INVALID PROCEEDINGS

By adding a new section 21.

21. When in any Statute, Ordinance, contract, document, instrument of any description or any statement reference is made to the Treasurer or to the Secretary General of the Faculties after the date of the approval of this Statute by Her Majesty in Council (here shall be inserted the date) such reference shall be construed as a reference to the Registrary, or a duly appointed deputy, unless different provision is made by Statute or Ordinance.
