EU Public Procurement Regulations: Notice

In their Annual Report for 2001-02 (paragraphs 23-24, Reporter, 2002-03, p. 421) the Council referred to legal action that had been taken to establish whether the University was outside the EU Public Procurement Regulations on the grounds that it was not wholly or mainly publicly funded. As a result of the clarification by the Courts of what constitutes both public funding and a definition of 'wholly or mainly' for the purpose of these Regulations, the Council, on the advice of their Finance Committee, have declared the University outside the scope of the Regulations, for 2003-04, as it is less than 50% publicly funded. The calculation will be carried out annually to ensure that it remains possible to make the declaration. It is the Council's intention that the University's procurement procedures should continue to follow the good practice set out in the Regulations and in the University's Financial Regulations.
